1. Who we are and what you are agreeing to
SPX Analytics ("SPX Analytics", "we", "us") is a market-data and research dashboard operated by [[legal entity name, e.g. — LLC]], [[registered business address]], at spxanalytics.com (the "Service").
These Terms of Service (the "Terms") are a binding agreement between you and us. By creating an account, subscribing to a paid plan, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.
Our Privacy Policy and Refund Policy are incorporated into these Terms by reference.
2. What SPX Analytics is — and what it is not
The Service pulls options-chain, price, and volatility data from third-party providers (Tradier, CBOE, Yahoo, FINRA) and presents the output as charts, gamma-exposure maps, a volatility-regime panel, and weighted directional predictor scores.
You acknowledge and agree that:
- We are not a registered investment adviser, broker-dealer, or financial institution, and are not registered with the SEC, FINRA, or any equivalent regulator.
- No fiduciary, advisory, or agency relationship is created between you and us by your use of the Service.
- Predictor scores, bias labels, and buy/sell crossover markers are deterministic output of formulas applied to market data. They are not opinions about your circumstances and take no account of your financial position, objectives, risk tolerance, or holdings.
- The Service does not connect to any brokerage, and does not place, route, or execute orders.
- Past performance of any indicator, model, or signal does not predict future results. Trading options, and especially 0DTE options, involves substantial risk, including total loss of capital in a single session.
- Every trading decision you make is yours alone. Consult a licensed professional before acting on anything shown in the Service.
3. Eligibility and your account
- You must be at least 18 years old and legally able to enter into a contract.
- An account is for one named person. Sharing credentials, or giving access to the Service to anyone who does not hold their own subscription, is a material breach of these Terms.
- You must give an accurate email address and keep it current — password resets and billing notices are sent there.
- You are responsible for your password and for everything done under your account. Tell us promptly at support@spxanalytics.com if you believe your account has been accessed without authorization.
Sessions are authenticated with a signed token that expires 24 hours after sign-in. Signing out clears it from your browser.
4. Plans, trial, and billing
- New accounts receive a free trial (see the Service for its current length) with full access, including the predictor models.
- After the trial ends, the SPX/VIX chart, gamma map, and volatility-regime panel remain free; the predictor models and their history require an active paid subscription.
- The paid plan is billed monthly ($25/mo) or yearly (30% off the monthly rate), through Stripe. We never see or store your card details — Stripe does.
- Subscriptions renew automatically until cancelled. You can cancel anytime from your Profile page; cancellation takes effect at the end of the current billing period.
- See our Refund Policy for how refunds (or the lack of one) work.
5. Acceptable use
- No scraping, reselling, or redistributing the Service's data or output at scale without our written permission.
- No attempting to bypass the paywall, rate limits, or account-per-person restriction.
- No using the Service for any unlawful purpose, or in a way that could disable, overburden, or impair it.
6. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Market data may be delayed, incomplete, or wrong — verify anything before acting on it.
To the maximum extent permitted by law, [[entity name]] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or trading losses, arising from your use of the Service, even if advised of the possibility of such damages.
7. Governing law
These Terms are governed by the laws of [[governing law, e.g. the State of Delaware, USA]], without regard to conflict-of-laws principles. Any dispute will be brought exclusively in [[exclusive forum]].
8. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
